Acceptance of Terms
By creating an account or using Tile Theory, you agree to these Terms of Service. If you do not agree, do not use the service.
Tile Theory Service
Tile Theory helps contractors organize project information, selections, and scope. Contractors can create a project, send a client a private link, and receive a structured project scope back. Tile Theory is a tool for organizing information; it does not perform construction, estimating automation, or project management beyond what is described here.
Accounts
You must be able to form a legally binding contract to create an account. You are responsible for keeping your login credentials secure and for activity under your account. You agree to provide accurate information when creating your account.
Contractor Responsibility
Tile Theory is an organizational tool. Contractors remain responsible for reviewing project conditions, verifying measurements, determining pricing, confirming code requirements, choosing construction methods, and reaching final agreements with clients. Tile Theory does not replace professional judgment or on-site verification.
Client Questionnaire Information
Client-provided information may be incomplete or inaccurate and should be verified by the contractor before relying on it. Tile Theory does not guarantee the accuracy of client answers and is not responsible for decisions made based on unverified client input.
Estimates / Scope Information
Project scopes generated through Tile Theory are summaries of the information entered and are intended to support, not replace, a contractor's own estimating and scoping process. Tile Theory is not responsible for estimating errors, pricing, or project outcomes.
No Professional Engineering / Legal / Code Advice
Tile Theory does not provide legal, engineering, architectural, or building-code advice. Nothing in the service should be interpreted as professional guidance for construction, compliance, or permitting. Consult qualified professionals for those needs.
User Content
You retain ownership of the information and content you provide. You grant Tile Theory a limited license to use your content only as needed to operate and display the service for you. You are responsible for ensuring you have the rights to any content you upload.
Acceptable Use
You agree not to misuse Tile Theory, including by attempting to access another contractor's data, interfering with the service, uploading harmful content, or using the service for unlawful activity. We may suspend or terminate access for violations.
Service Availability
We strive to keep Tile Theory available but do not guarantee uninterrupted access. The service may be updated, changed, or discontinued, and we are not liable for outages, data loss, or interruptions beyond our control.
Intellectual Property
Tile Theory, its branding, and its software are owned by Tile Theory and its licensors. Your content remains yours as described above. Do not copy, redistribute, or reverse-engineer the service without permission.
Third-Party Services
Tile Theory uses third-party services for authentication and email delivery. We are not responsible for the practices of these providers, and their use is subject to their own terms and policies.
Disclaimer of Warranties
Tile Theory is provided "as is" and "as available" without warranties of any kind. We do not warrant that the service will be error-free, secure, or available at all times, or that project scopes will be accurate or complete.
Limitation of Liability
To the fullest extent permitted by law, Tile Theory is not liable for construction defects, code compliance, estimating errors, project outcomes, or any indirect, incidental, or consequential damages arising from your use of the service.
Termination
You may stop using Tile Theory at any time. We may suspend or terminate your account if you violate these Terms or if we believe your use creates risk or liability. Upon termination, your right to use the service ends, though your content may be retained according to our data practices.
Changes to Terms
We may update these Terms from time to time. We will post the updated version on this page with a revised date. Continued use of Tile Theory after a change means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Tile Theory operates, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.
